The State has filed a notice of motion to stay the orders issued by Justice Cannings last Friday that the appointment of David Manning as Commissioner of Police and Secretary for the Department of Police was unlawful and that he vacates the Office of the Commissioner of Police by 12 midday on 29 January 2021.
The notice of motion was filed yesterday (Tuesday 26 January) before His Honour Justice Dereck Hartshorn who set the case for 3.30pm today (Wednesday 27 January) and directed that the first and second respondent (Sylvester Kalaut and Fred Yakasa) Yakasa) be served before 12noon today.
At 3.30pm today (Wednesday 27 January) lawyer for the first and second respondents (Sylvester Kalaut and Fred Yakasa), David Datona of Datona Lawyers argued that his clients were only served at 11.30am today and therefore required more time to prepare.
Justice Hartshorn deferred the case to 9.30 am tomorrow (Thursday 28 January, 2021).
